Terms of Service

The short version: PaidFair is a subscription tool that helps you schedule, track hours, and split tips fairly. It keeps records — it never moves money. You're responsible for the accuracy of what you enter and for your own payroll, tax, and labor-law obligations. You can cancel anytime. The service is provided "as is."

1. Who these terms are between

These Terms of Service ("Terms") are an agreement between you (and the business you represent) and Striven Industries LLC ("we," "us"), operator of PaidFair (the "Service"). By creating an account or using the Service, you agree to these Terms. If you're agreeing on behalf of a business, you represent that you're authorized to bind that business.

2. What PaidFair does — and doesn't do

PaidFair helps you build schedules, clock staff in and out, count tips, allocate them fairly by who actually worked each stretch, and hand clean hours and tips to whoever runs your payroll. It also includes a free cash-drawer register, notes, tasks, guides, and supply tracking.

PaidFair does not move, hold, or transfer money. It does not process payroll, run direct deposit, cut checks, or transmit funds between people. Any cash handed from one person to another is recorded by you as a fact that already happened; PaidFair is a record of it, nothing more. PaidFair is not a bank, money transmitter, payment processor, or payroll provider.

4. Subscriptions and billing

PaidFair is offered on a subscription basis. Current pricing is shown on our pricing page. Paid plans begin after any free trial and renew automatically each billing period until cancelled. Billing is handled by Stripe; by subscribing you also agree to Stripe's terms. You authorize us, through Stripe, to charge your payment method on each renewal.

The cash-drawer register is free to use. We may change prices or plan features; if we do, we'll give notice and any change applies to the next billing period, not retroactively.

5. Free trial

If we offer a free trial, we won't charge you until the trial ends. You can cancel before the trial ends to avoid a charge. Unless stated otherwise, one trial per business.

6. Cancellation and refunds

You can cancel anytime from the billing settings in the web console. Cancellation stops future renewals; you keep access through the end of the period you've already paid for, and your data is kept. Except where required by law, payments are non-refundable. You can export your data before you cancel. Deleting your account is separate from cancelling: it removes your account and shop data and ends billing immediately. Subscriptions purchased through the Apple App Store are managed by Apple and must be cancelled in your Apple ID settings.

7. Your data

Your business records belong to you. We process them only to provide the Service, as described in our Privacy Policy. We don't sell your data or use it for advertising. You can export your records, and you may request deletion of your account.

8. Acceptable use

Don't use the Service to break the law, infringe others' rights, or misrepresent hours, wages, or tips owed to workers. Don't attempt to breach security, disrupt the Service, reverse-engineer it beyond what the law allows, resell it, or use it to build a competing product. We may suspend accounts that put the Service or other customers at risk.

9. Availability

We work to keep PaidFair reliable, but we don't guarantee uninterrupted or error-free operation. We may perform maintenance, update features, or change the Service over time. The iPhone app keeps a local copy of your shop so it continues to work offline.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that any allocation, export, or calculation will meet your legal obligations — that's on you to verify. PaidFair does not provide legal, tax, accounting, or payroll advice.

11. Limitation of liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your data, or your violation of these Terms or of any law — including wage, tip, or labor-law claims by your workers or authorities.

13. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends; sections that by their nature should survive (data, disclaimers, liability, indemnity, governing law) survive.

14. Changes to these terms

We may update these Terms. If we make material changes, we'll post the updated version at this URL and revise the effective date above. Continuing to use the Service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State in which Striven Industries LLC is organized, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
